  1. This matter is taken up through Hybrid Arrangement (Virtual /Physical Mode).

  2. Heard learned counsel for the Petitioners as well as learned Additional Government Advocate for the State-Opposite Parties. Perused the writ application as well as the documents annexed thereto.

  3. By filing the present writ application, the Petitioners call in question the conduct of the Opposite Parties in treating the Junior Teachers (Schematic), who were appointed in the year 2023-24 as senior to the present Petitioners. In course of his argument, learned counsel for the Petitioners contended that the Petitioners were initially engaged as Junior Teachers (Contractual) in the year 2018. Upon completion of 3 years of service, they were engaged as Junior Teachers and, finally, with effect from 11.12.2024, they were appointed as regular teachers Elementary. He further contended that in the meantime the Opposite Parties have changed the rules by virtue of the notification dated 02.04.2026 whereby the Junior Teachers (Schematic), who were engaged in the Primary and Upper Primary School during the year 2023-24 and were issued with the engagement order in the year 2024, have been regularized from the date of their initial engagement. As a result, such Junior Teachers (Schematic) are likely to be placed above the present Petitioners, who were initially recruited in the year 2018 in the gradation list. He further contended that the decision of the Government vide notification dated 02.04.2026 at Annexure-10 has not been implemented so far. Being aggrieved by such notification, the Petitioners have approached this Court by filing the present writ application.

  1. Learned Additional Government Advocate for the State-Opposite Parties sought for some time to obtain instruction in the matter.

  2. Considering the prayer of the learned counsel for the State, he is granted four weeks’ time to obtain instruction in the matter.

  3. List this matter in the week commencing 29.06.2026.

  2. As an interim measure, it is directed that the decision vide notification dated 02.04.2026 of the S&ME Department, Government of Odisha at Annexure-10 shall not be given effect to till the next date.
