Cabinet approved Medical Termination of Pregnancy Amendment Bill 2020

Chaired by Prime Minister Shri Narendra Modi, the Union Cabinet has approved the Medical Termination of Pregnancy (Amendment) Bill, 2020, to amend the Medical Termination of Pregnancy Act, 1971. The Bill will be introduced at the subsequent Parliamentary session.

Special features of the planned modifications

Proposing requirement for opinion of one provider for termination of pregnancy, up to 20 weeks of gestation and introducing the requirement of opinion of two providers for termination of pregnancy of 20-24 weeks of gestation.
Enhancing the upper gestation limit from 20 to 24 weeks for special categories of women which will be defined in the amendments to the MTP Rules and would include 'vulnerable women including survivors of rape, victims of incest and other vulnerable women (like differently-abled women, Minors) etc.
Upper gestation limit not to apply in cases of substantial foetal abnormalities diagnosed by Medical Board. The composition, functions and other details of Medical Board to be prescribed subsequently in Rules under the Act.
Name and other particulars of a woman whose pregnancy has been terminated shall not be revealed except to a person authorised in any law for the time being in force.

The Medical Termination of Pregnancy (Amendment) Bill, 2020 is for expanding access of women to safe and legal abortion services on therapeutic, eugenic, humanitarian or social grounds. The proposed amendments include substitution of certain sub-sections, insertion of certain new clauses under some sections in the existing Medical Termination of Pregnancy Act, 1971, with a view to increase upper gestation limit for termination of pregnancy under certain conditions and to strengthen access to comprehensive abortion care, under strict conditions, without compromising service and quality of safe abortion.

It is a step towards safety and well-being of the women and many women will be benefited by this. Recently several petitions were received by the Courts seeking permission for aborting pregnancies at a gestational age beyond the present permissible limit on grounds of foetal abnormalities or pregnancies due to sexual violence faced by women. The proposed increase in gestational age will ensure dignity, autonomy, confidentiality and justice for women who need to terminate pregnancy.

In order to increase access of women to safe abortion services and taking into account the advances in medical technology, the Ministry of Health and Family Welfare proposed amendments after extensive consultation with various stake holders and several ministries.

ଯେତେବେଳେ କର୍ମଚାରୀ ସଂଗଠନ ଦୂର୍ବଳ ହୋଇଯାଏ, ସେତେବେଳେ ନିଜର ହକ୍ ପାଇଁ ମଧ୍ୟ ପାଟି ଫିଟାଇ ହୁଏ ନାହିଁ। ଆଉ ଅଧିକ କିଛି ପାଇଁ ଦାବୀ କରିବା ତଥା ଆନ୍ଦୋଳନ କରିବାର ସୁଯୋଗ କିମ୍ବା ଅଧିକାର ନଥାଏ କହିଲେ ଚଳେ। ଆଜି ସଚିବାଳୟ ସେବା ସଂଘ (ଓସା)ର ମଧ୍ଯ ସେଇ ଅବସ୍ଥା। ଏତେ ସରି ହେବା ପରେ ମଧ୍ଯ ସଂଘର କର୍ମକର୍ତ୍ତା ନିଜକୁ ଲଜ୍ଜିତ ମନେ କରୁନାହାନ୍ତି କିମ୍ବା ସଂଘର ଗାରିମା ରକ୍ଷା ପାଇଁ ଲେଶମାତ୍ର ପ୍ରଚେଷ୍ଟା କରୁନାହାନ୍ତି। ୨୦୧୫-୨୦୧୭ ତଥା ୨଼୦୧୭-୨୦୧୯ ସମୟରେ ଦାୟିତ୍ବରେ ଥିବା ଦୁଇଗୋଷ୍ଠୀ ପରସ୍ପର ଉପରେ ସଂଘର ଅର୍ଥ ଆତ୍ମସାତ୍ କରିଥିବାର ଅଭିଯୋଗ ଆଣିଛନ୍ତି। କିନ୍ତୁ ଏ ସଂପର୍କରେ ଆଲୋଚନାକୁ କେହି ଆସୁନାହାନ୍ତି। ସବୁଠାରୁ ଦୁଖର କଥା, ଆସୋସିଏସନ କାର୍ଯ୍ୟାଳୟକୁ ମଧ୍ୟ କେହି ଯିବାର ଆଗ୍ରହ ଦେଖାଉନାହାନ୍ତି। ଇତି ମଧ୍ୟରେ ଓସା ହାଉସ୍ ରେ ବିଜୁଳି ନାହିଁ। ଜଣେ କେୟାର ଟେକର (କାଳିଆ) ରୋଗର ଉପଚାର କରି ନପାରି ମ୍ରୃତ୍ୟୁ ବରଣ କରିସାରିଲାଣି। ସରକାରଙ୍କର କୌଣସି ପ୍ରକାର କର୍ମଚାରୀ ମାରଣ ନିଷ୍ପତ୍ତିକୁ ବିରୋଧ କରାଯାଉ ନାହିଁ। ରାଜ୍ୟ ସରକାରଙ୍କ କର୍ମଚାରୀ ଆଜି ୫% ମହଙ୍ଗା ଭତ୍ତା, ନୂତନ ହାରରେ ଘରଭଡ଼ା ତଥା ୬୦% ବକେୟା ପାଉଣା ପାଇନାହାନ୍ତି। ଏଥିପାଇଁ ସରକାରଙ୍କ ନିକଟରେ ଅଭିଯୋଗ କରିବ କିଏ?

ଇତିମଧ୍ୟରେ କିଛି ସଂଘପ୍ରେମୀ ଏଏସଓ ବନ୍ଧୁ ବିଗତ ଦିନର ସବୁ ଘଟଣାକ୍ରମକୁ ଦେଖିଲାପରେ ଏବଂ ଓସାର ଏକ ପ୍ରକାର ଅଚଳାବସ୍ଥା ତଥା ସଭ୍ଯମାନଙ୍କ ସଂଘପ୍ରତି ଆନ୍ତରିକତା କମିଯାଉଥିବାର ଲକ୍ଷ୍ଯ କରି ନିଜ ତରଫରୁ ଆଗକୁ ଆସିଛନ୍ତି। ଯଦିଓ ଅତୀତରେ ସ୍ବରାଷ୍ଟ୍ର ବିଭାଗ କୁ ପ୍ରାୟ ୧୨୦୦ ଦସ୍ତଖତ ସମ୍ବଳୀତ ଆବେଦନ ବିଫଳ ହୋଇଛି, ସମସ୍ତ ନିୟମକାନୁନ ତଥା ବିକଳ୍ପ ଚିନ୍ତାଧାରା କୁ ଆଧାର କରି ଓସା ନିର୍ବାଚନ କିପରି କରାଯାଇପାରିବ ସେ ସଂପର୍କରେ ଅଧିକ ମାନସ ମନ୍ଥନ ତଥା ଉପାୟ ବାହାର କରିବା ପାଇଁ ସବୁ ସ୍ତରର ବରିଷ୍ଠ ତଥା ସଂଘୀୟ ବ୍ଯବସ୍ଥା ସହ ଜଡିତ ପ୍ରାୟ ୩୦ ସଭ୍ୟଙ୍କୁ ନେଇ ଗତ ତା. ୨୪.୦୧.୨୦୨୦ ରିଖରେ ଏକ ଆଲୋଚନାମୂଳକ ବୈଠକ ଆହ୍ବାନ କରିଥିେଲ। ସୁଖର କଥା, ଅନୁରୋଧ ରକ୍ଷା କରି ଅନେକ ଏଥିରେ ଯୋଗଦେଇ ଥିଲେ। ସମସ୍ତ ମତାମତ ଶୁଣିଲା ପରେ ସର୍ବସମ୍ମତି କ୍ରମେ ୨୮.୦୧.୨୦୨୦ ରେ ଏକ ବୈଠକ କରି ୨୦୧୭-୨୦୧୯ ସମୟର ଓସା କର୍ମକର୍ତ୍ତାଙ୍କୁ ଡାକି ନିର୍ବାଚନ ସମ୍ବନ୍ଧରେ ଆଲୋଚନା ପାଇଁ ନିଷ୍ପତ୍ତି ନିଆଗଲା। ବହୁ ଦୁଃଖ ତଥା ଲଜ୍ଜାର ସହ କହିବାକୁ ପଡୁଛି କି, କେବଳ ଅଜିତ, ତନ୍ମୟ ଓ ପ୍ରଜତ୍ନ କୁ ଛାଡି ଅନ୍ଯ ମାନେ କେହି ଆସିଲେ ନାହିଁ। ସ୍ମରଣ ଯୋଗ୍ୟ, କମ୍ପୋଜିଟ ଡିପାର୍ଟମେଣ୍ଟ ସଂପର୍କରେ ଆସିଥିବା ରିଜୋଲ୍ୟୁସନ ସଂପର୍କରେ ଏହିପରି ଏକ ଆଲୋଚନା କୁ ମଧ୍ଯ ସେମାନେ ଆସିନଥିଲେ। ତେବେ ନିଜର କାର୍ଯ୍ଯକାଳ ସରିବା ପରେ ମଧ୍ଯ ପଦକୁ ସମ୍ମାନ ଦେଇ ସମସ୍ତେ ଅନୁରୋଧ କରିବା ସତ୍ତ୍ବେ ହେୟ ମନେକରି ନ ଆସିବା କି ପ୍ରକାରର ଚିନ୍ତାଧାରା?

ଯଦିଓ ଉଭୟ ପୂର୍ବତନ ସଭାପତି ଓ ସାଧାରଣ ସଂପାଦକ ସଂଘର ଅର୍ଥ ତୋଷରପାତ କଥା କହି ଚୁପ ବସିଛନ୍ତି କିନ୍ତୁ ପ୍ରାୟ ଅନ୍ୟ ସମସ୍ତେ ଓସାର ଉତ୍ଥାନ ପାଇଁ ଖୁବ ଶୀଘ୍ର ନିର୍ବାଚନ ଚାହାଁନ୍ତି। ମାତ୍ର ଏଥିପାଇଁ ଉଭୟ ପକ୍ଷର ଯୁକ୍ତି ବଡ ବିଚିତ୍ର ।
୧. ସଭାପତି ଚାହାଁନ୍ତି, ସ୍ବରାଷ୍ଟ୍ର ବିଭାଗ ତାଙ୍କୁ ନିର୍ବାଚନ କରାଇବା ପାଇଁ କ୍ଷମତା ପ୍ରଦାନ ସହ ଚିଠି ଲେଖୁ।
- କିନ୍ତୁ ସଭ୍ୟ ମାନେ ଦସ୍ତଖତ କରି ସରକାରଙ୍କୁ ପୁଣି ଚିଠି ଲେଖି ସଂଘର ଅଧିକ କ୍ଷତିକରି ଲଜ୍ଜିତ ହେବାକୁ ଚାହୁଁନାହାନ୍ତି।
୨. ସଂପାଦକ କୁହନ୍ତି, ଯେହେତୁ ପୂର୍ବ ସଂପାଦକ (ବର୍ତ୍ତମାନ ସଭାପତି) ସଂଘର ହିସାବ ଦେଇନାହାନ୍ତି, ତେଣୁ ନିଜେ ମଧ୍ଯ ହିସାବ ଦେବେନାହିଁ।
- କିନ୍ତୁ ପ୍ରଶ୍ନ ଉଠେ, ୨୦୧୭ ନିର୍ବାଚନ ପାଇଁ ନିର୍ବାଚନ କମିଶନର ଘୋଷଣା ପୂର୍ବରୁ ଜେନେରାଲ୍ କାଉନସିଲ ବୈଠକ ରେ ଆୟବ୍ୟୟର ହିସାବ ନିଶ୍ଚିତ ଦିଆଯାଇଥିବ । ସେତେବେଳେ କିମ୍ବା ୨଼୦୧୭-୨୦୧୯ ପାଇଁ ଦାୟୀତ୍ୱ ନେଲାବେଳେ କାହିଁକି ପ୍ରଶ୍ନ କରିନଥିଲେ? ପୁଣି, ଓସାର କୌଣସି ସଭ୍ୟ ଏହି ହିସାବ ସମ୍ବନ୍ଧ ରେ ପ୍ରଶ୍ନ କରୁନଥିବା ବେଳେ ସେହି ବାହାନାରେ ନିଜେ ନିଜ ସମୟର ହିସାବ ନଦେଇ ନିର୍ବାଚନ କରାଇ ନଦେବା କେତେ ଯୁକ୍ତି ଯୁକ୍ତ?
୩. ସଭାପତି କୁହନ୍ତି, ନିର୍ବାଚନ ଖର୍ଚ୍ଚ ପାଇଁ ୧ ଲକ୍ଷ ଟଙ୍କା ଆସିବ କେଉଁଠାରୁ?
- ଯଦି ବର୍ତ୍ତମାନର କର୍ମକର୍ତ୍ତା ଟଙ୍କା ନଦିଅନ୍ତି (କିନ୍ତୁ ପରେ ହିସାବ ଦେବାକୁ ବାଧ୍ଯ) ତେବେ ଆଶା କରାଯାଇପାରେ, ସମସ୍ତ ସଭ୍ଯା/ସଭ୍ଯ ସଭ୍ଯ ଚାନ୍ଦା ହିସାବରେ ଅତିକମରେ ୧୦୦ ଟଙ୍କା ଲେଖାଏଁ ଦେଇପାରିବେ ଯାହାକି ୧,୦୦,୦୦୦ ଟଙ୍କା ରୁ ଅଧିକ ହେବ ଏବଂ ନିର୍ବାଚନ ସୁରୁଖୁରୁରେ ହୋଇପାରିବ।
୪. ସଂପାଦକ କୁହନ୍ତି, ସେ ହିଁ କେବଳ କୁଆଡେ ସରକାରଙ୍କ ଠାରୁ ଆଲୋଚନା ପାଇଁ ତାରିଖ ଆଣିଛନ୍ତି ଏବଂ ଏହି ଦୁଇ ବର୍ଷରେ ଓସା ପାଇଁ ଐତିହାସିକ ସଫଳତା ଆଣିଛନ୍ତି।
- ଅଥଚ ନିଜ କ୍ଯଡରର ଭାଇ ମାନଙ୍କ ଗହଣରେ ନିର୍ଧାରିତ ତାରିଖରେ ବସି ପରୁନାହାନ୍ତି। ଆଉ ଏବେକାର ସ୍ଥାଣୁତା ନିଶ୍ଚିତ ଭାବେ ଇତିହାସ ହୋଇ ରହିବ।

ଯେତେବେଳେ ସଭ୍ଯ ମାନେ ସଂଘକୁ ଏକ ସୁସ୍ଥ ବାତାବରଣ ଦେଇ ଆଗକୁ ନେବା ପାଇଁ ଚେ଼ଷ୍ଟା କରୁଛନ୍ତି, ସେତେବେଳେ କର୍ମକର୍ତ୍ତାଗଣ ଟିକେ ହେଲେ ସହଯୋଗ କରୁନାହାନ୍ତି। ସେମାନେ ଭୁଲି ଯାଉଛନ୍ତି ଯେ ସଂଘ ପାଇଁ ସେମାନଙ୍କ ପରିଚୟ ଏବଂ ସଭ୍ଯ ପାଇଁ ସଂଘର ସ୍ଥିତି। ଯଦି ଏପରି ଅଚଳାବସ୍ଥା ରେ ସେମାନେ ସହଯୋଗ କରନ୍ତି, ତେବେ ସଭ୍ଯମାନେ ସମସ୍ତ ନିୟମକୁ ବାଦ ଦେଇ ସିଧାସଳଖ ଜେନେରାଲ ବଡି ବୈଠକ ଡକାଯାଇ ନିର୍ବାଚନ ପାଇଁ ବ୍ଯବସ୍ଥା କରିବାକୁ ବାଧ୍ଯ ହେବେ। ଏଥିପାଇଁ ସମସ୍ତଙ୍କ ସହଯୋଗ ଆଶା କରାଯାଏ।

Dear fellow citizens,

On the eve of our 71st Republic Day, I extend my warm greetings to all of you, in India and abroad.

Seven decades ago, on 26th January, our Constitution came into effect. Even before that, this date had acquired special significance. Having resolved to attain ‘Purna Swaraj’, our people had been celebrating ‘Purna Swaraj Day’ on every 26th January from 1930 to 1947.
