No more spam SMS from companies : consent required

 Ministry of Communication

Implementation of Digital Consent Acquisition (DCA) under TCCCPR-2018

Posted On: 07 NOV 2023 3:50PM by PIB Delhi

Various entities such as banks, other financial institutions, insurance companies, trading companies, business entities, real estate companies, etc. send commercial messages to telecom subscribers thorough SMS or voice calls. These entities are referred to as Principal Entities (Pes) or Senders in Telecom Commercial Communications Customer Preference Regulations, 2018 (TCCCPR-2018).

TRAI in its endeavour to curb the menace of spams through Unsolicited Commercial Communications (UCC) has taken various measures in recent past. In this pursuit, TRAI issued Direction dated 02.06.2023 under TCCCPR-2018 to all the Access Providers to develop and deploy the Digital Consent Acquisition (DCA) facility for creating a unified platform and process to register customers’ consent digitally across all Access Service Providers and Principal Entities.

In the prevalent system, the consent is obtained and maintained by various Pes. Therefore, it is not possible for the Access Providers to check veracity of consents. Further, there is no unified system for customers to provide or revoke the consent. The Digital Consent Acquisition (DCA) process has facility to seek, maintain, and revoke the consents of customers, as per the processes envisaged under TCCCPR-2018. The consent data so collected will be shared on Distributed Ledger Technology (DLT) Platform, established under TCCCPR-2018 for Commercial Communications, for scrubbing by all Access Providers.

A common short code 127xxx will be used for sending consent seeking messages. The purpose, scope of consent, and Principal Entity/Brand name shall be mentioned clearly in the consent seeking message sent through the short code. Only whitelisted URLs/APKs/OTT links/Call Back numbers, etc. shall be used in the consent seeking messages. The consent acquisition confirmation message to the customers shall also have information related to revocation of the consent. Further, Access Providers shall develop a SMS/ Online facility to register unwillingness of the customers to receive any consent seeking message initiated by any Principal Entity.

It is specifically highlighted that after implementing DCA, the existing consents, acquired through alternative means, shall be rendered null and void and fresh consents will have to be sought by all Pes through digital means only.

All the Principal Entities are hereby requested to take urgent necessary steps to be onboard the DCA system as per the timelines prescribed in Direction dated 02.06.2023. For any clarification/ information/ details in the matter, Pes may contact the concerned Access Providers.

Dear Members,
The esteemed Chief Secretary, Odisha and Additional Chief Secretary, Home Department discussed at 5.30PM & 6.00PM  respectively in their office chambers.
They assured the delegates that the demands of the Association are under active consideration of the Government and these have already been discussed at length at the highest forum of the Government. Very soon the matter will be placed in the Inter Ministerial Committee.
The Government is very cordial and kin to take a very rational decision on our demands at the appropriate time. The Additional Chief Secretary, Home Department advised that the Association should keep patience and cooperate with Government to find a feasible solution on the demands of the OSS Cadre and do not resort to any Dharana programmes which will convey a very wrong message to the public.
In view of the present development, it is unanimously decided by the Executive Body to postpone the peaceful ‘Dharana’ scheduled to be held in the Palm Court of Lok Seva Bhawan on 3rd, November 2023 (Today) reposing strong faith and belief in the words of the Chief Secretary, Odisha and Additional Chief Secretary to Government, Home Department.

Appointment of Chief Justice, High Court of Orissa

SUPREME COURT OF INDIA

Re: Appointment of Mr Justice Chakradhari Sharan Singh, Judge, High Court of Judicature at Patna, as the Chief Justice of the High Court of Orissa.

A vacancy in the office of the Chief Justice of the High Court of Orissa has arisen consequent upon the retirement of Mr Justice Subhasis Talapatra on 3 October 2023. Therefore, an appointment to that office is required to be made.

Para 3 of the Memorandum of Procedure relating to the appointment of the Chief Justice of a High Court provides as under:

“A fair representation shall be given to various High Courts for selection of Chief Justices. For purposes of such selection, inter-se seniority of puisne Judges will be reckoned on the basis of their seniority in their own High Court. The consideration for appointment of Chief Justices shall be based on the criterion of seniority subject to merit and integrity.”

It is proposed to appoint Mr Justice Chakradhari Sharan Singh as the Chief Justice of the High Court of Orissa. Mr Justice Chakradhari Sharan Singh was appointed as a Judge of the High Court of Judicature at Patna on 5 April 2012 and has been functioning there as the senior-most puisne Judge. Before his elevation as a Judge of the High Court, he was enrolled at the Bar in 1990 and practised at the High Court of Judicature at Patna. His area of practice was constitutional, service, criminal and arbitration matters. During his practice of 22 years he also served as Additional Advocate General for the State of Bihar since December 2010 till his elevation as a Judge of High Court. As regards his contribution to the judiciary by way of disposal of cases, during his tenure of more than 11 years as a Judge of High Court, he authored 1246 reported judgments, of which 562 were delivered during last 5 years. He has maintained high standard of professional ethics at the Bar and Bench and enjoys good reputation for conduct and integrity. While recommending the name of Mr Justice Chakradhari Sharan Singh, the Collegium has also taken into consideration the fact that at present the High Court of Judicature at Patna has no representation among the Chief Justices of High Courts.

Having regard to all relevant factors, the Collegium is of the considered view that Mr Justice Chakradhari Sharan Singh is fit and suitable in all respects for being appointed as the Chief Justice of the High Court of Orissa.

The Collegium, therefore, resolves to recommend the appointment of Mr Justice Chakradhari Sharan Singh as the Chief Justice of the High Court of Orissa.
