Modifications in RACP Scheme guidelines

In exercise of power conferred under Rule-19 of the ORSP Rules' 2008, the Government is now pleased to bring following modifications in Para-1 and Para-10 of the RACP Scheme guideline issued vide this Department Resolution No.3560/F, dated 06.02.2013. (Download.PDF)

MODIFICATIONS 

a) The words "in a single cadre" mentioned in first sentence of Para-1 of Annexure-l of Finance Department Resolution No.3560/, dated 06.02.2013 are hereby deleted.

b) Para-10 of Annexure-l of the said Resolution is substituted by the following paragraph.

"10. Benefit of pay fixation available at the time of regular promotion shall also be allowed at the time of financial upgradation under the Scheme, which means the pay shall be raised by 3% of total of pay in the Pay Band and the Grade Pay drawn before such upgradation. 

The words "in a single cadre" mentioned in first sentence of Para-1 of Annexure-l of Finance Department Resolution No.3560/, dated 06.02.2013 are hereby deleted. 

Para-10 of Annexure-l of the said Resolution is substituted by the following paragraph. 

(i) The employees, who do not have any promotional hierarchy in their existing cadre nor have any scope for selection into a post of another cadre carrying higher pay, will get next higher Grade Pay available in the First Schedule of the ORSP Rules' 2008. 

(ii) The employees having only one or two promotional hierarchies in their existing cadre and not having any scope for selection into a post of another cadre carrying higher pay, will get Grade Pay attached to the promotional post(s) of their existing cadre and, thereafter, next higher Grade Pay available in the First Schedule of the ORSP Rules' 2008. 

(iii) The employees having three or more promotional hierarchies in their existing cadre; with/without having scope for selection into a post of another cadre carrying higher pay, will get Grade Pay attached to the promotional posts in their existing hierarchy, up to three promotions. 

(iv) The employees who do not have any promotional hierarchy in their existing cadre; but have scope for selection into a post of another cadre carrying higher pay, will get Grade Pay of the post of that another cadre subject to satisfying the eligibility criteria for selection to the said post of the said another cadre. However, if an employee does not satisfy the eligibility criteria for selection to the said post of the said another cadre, he will be entitled for next higher Grade Pay available in the First Schedule of the ORSP Rules' 2008. 

In case the new Grade Pay corresponds to a different Pay Band, the employee will get the Pay Band corresponding to the revised Grade Pay. There shall, however, be no further fixation of pay at the time of  regular promotion

This modification shall take effect retrospectively from the date of implementation of the RACP Scheme, i.e. from 01.01.2013. 

Pre-conditions to avail RACP benefits as stipulated in Finance Department Resolution No.3560/F, dated 06.02.2013 shall remain unaltered.

Wherever required in accordance with this modification, RACP benefit already sanctioned in favour of any serving or retired/superannuated employee shall be revised by revising their pay/pension and arrear pay/pension shall be disbursed to the employee concerned, as admissible, irrespective of whether the employee has/had taken shelter of Court or not. Disposal/withdrawal of the Court case, if any, shall not be a pre-condition to revise RACP benefit and/or to disburse arrear pay/pension.

Arrears of DA/DR frozen during COVID-19 : Parliament Question

QUESTION
a) Whether dearness allowance and dearness relief for Central Government employees and pensioners during the Covid-19 were withheld for 18 months but not seized;
b) If so, the details thereof and the reasons for its seizure by the Government;
c) Whether the Government would release the same to ensure spending by the Government employees and thereby help in boosting the faltering economy of the Country;
d) If so, the details thereof ;
e) If not, the reasons therefor?

ANSWER
(a) & (b) The decision to freeze three installments of Dearness Allowance (DA) / Dearness Relief (DR) to Central Government employees/ pensioners due from 01.01.2020, 01.07.2020 & 01.01.2021 was taken in the context of COVID-19, which caused economic disruption, so as to ease pressure on Government finances.
(c) No.
(d) Does not arise.
(e) The adverse financial impact of pandemic in 2020 and the financing of welfare -measures taken by the Government had a fiscal spill over beyond FY 2020-21. Therefore, arrears of DA/DR were not considered feasible.

8th Central Pay Commission – Parliament Question

QUESTION

(a) whether Union Cabinet has approved constitution of 8th Central Pay Commission (CPC) for Central Government employees and pensioners during January, 2025;
(b) if so, the details thereof:
(c) by when the Chairperson and Members of the 8th CPC would be appointed and by when notification for it’s constitution would be issued; and
(d) the timeline for 8th CPC for submission of it’s report to the Government?

ANSWER
(a) & (b): The Government has approved constitution of the 8th Central Pay Commission.
(c) & (d): Will be decided in due course.

Recognition of Bali Jatra as a National Fair

Bali Jatra commemorates rich maritime heritage and culture of Odisha

Bali Jatra is a festival that commemorates the maritime trade and cultural exchange between Odisha and Southeast Asian countries, particularly Bali. The festival is celebrated annually in Cuttack, Odisha, and attracts million of visitors. The term Bali Jatra literally means ‘Voyage to Bali’. Every year Kartika Purnima marks the day that the seafaring traders departed for the Indonesian islands. For this festival, people of Odisha gather in large numbers in colourful attire to celebrate their glorious maritime history. The celebration features grand fairs, elaborate rides, food and dance. Indian women perform ‘Boita Bandana’, they make boats of paper or banana leaf (sholapith) with lighted lamps inside and float them down the Mahanadi as a part of the celebrations. The Bali Jatra celebrates the ingenuity and skill of those expert sailors who made Kalinga, one of the most prosperous empires of its time.

The festival is organized by Department of Culture and Tourism, Govt. of Odisha. Eastern Zonal Cultural Centre (EZCC), Kolkata, an autonomous organization under Ministry of Culture, participates in this event by way of providing cultural troupes during the Jatra for organizing cultural programmes, the details of which are as under:

Under Azadi Ka Amrit Mahotsav, a three-day National Dhara event ‘Samudramanthan’ was organized at the Odisha Maritime Museum at Cuttack to focus on the State’s glorious seafaring history, coinciding with the inauguration of the historic Bali Jatra. The event included panel and round-table discussions on the country’s maritime history locations, traditions, ship building, navigation, trade and cultural exchange, maritime security and international law.

The Jatra facilitates cultural exchange between Odisha and other States, promoting cross-cultural understanding. The Jatra also provides a platform for traditional Odia artists, craftsmen and musicians to showcase their skills which help to revive and promote Odia Culture.

This information was given by Union Minister for Culture and Tourism Shri Gajendra Singh Shekhawat in a written reply in Rajya Sabha today.

Odisha allows registration of pre-RERA apartments

No.2185─HUD-TP-POLICY-0005/2020/HUD. ─ This is with reference to the .Odisha Apartment (Ownership and Management) Act, 2023 (Odisha Act 7 of 2023) hereinafter referred to as the OAOM Act, which came into force on dated 28th June, 2023.

The OAOM Act was enacted to consolidate and streamline laws related to apartment ownership and management. Given that common areas and facilities are integral to any apartment, the Act also aligns their ownership and management with the provisions of the Real Estate (Regulation and Development) Act, 2016 (RERA).One of the major objectives of the Act is to safeguard the interests of allottees by ensuring appropriate rights over common areas and facilities.

However, it has come to notice that apartment owners are facing difficulties in registering sale deeds and transfer deeds due to perceived ambiguities in the application of the Act. There is a misconception that OAOM Act has retrospective effect, leading to inconsistencies in registration processes. Registration officers are reportedly interpreting the provisions of OAOM Act and RERA differently, causing disparities in decision-making across cases.

To address these concerns and remove any ambiguity, the Housing and Urban Development Department issues the following clarification:

“Without prejudice to any existing Acts and Rules, it is hereby clarified that Registration Authorities shall not deny the registration of any apartment citing provisions of OAOM Act, if the apartment was completed before the commencement of RERA in the State, i.e. prior to dated 25th February, 2017. Accordingly, the Department of Revenue & 
Disaster Management will be requested to issue suitable instructions to the Registration Officers to facilitate the registration of such apartments.”

This notification is issued for guidance of all concerned.
